According to a Rome News-Tribune report from March 31, Andrew Horton has been indicted on a charge of tampering with evidence.

The indictment stems from circumstances surrounding the shooting death of a Berry student, Joseph McDaniel, at an off-campus apartment in October 2017.

Horton, the roommate of McDaniel at the time of the shooting, was a witness for the prosecution in the October 2018 trial of two men who were charged with McDaniel’s death.

Troy Cokley, 19, and Ricket Carter, 19, were eventually found not guilty of murder.

The Rome News-Tribune reported that Horton was given limited immunity in exchange for assisting the prosecution. He admitted to removing marijuana and other evidence from the apartment after McDaniel was shot before calling 911.

According to the Columbus Ledger-Enquirer, no one called the police until nearly an hour after McDaniel had been shot, and the gun that was used was never found.
